Terms and Conditions
These terms and conditions apply to all orders for delivery.
Placing an order constitutes your acceptance of these Terms and Conditions. Despatch or delivery (if applicable) of the products by us constitutes acceptance of the order by us and therefore commencement of our contract to supply.
Your contract for supply is with Newpath Ventures Ltd. Your statutory rights are not affected by any of these terms.
Newpath Ventures is committed to supplying high quality products to households for personal use and recreational gardeners. If you wish to buy from us for resale or commercial gain we ask you contact us to discuss. In accordance with the established custom of the trade, Newpath Ventures will in no case be liable for more than the actual amount paid for a particular item.
We will endeavour only to offer products which we expect to have in stock and available for ordering, but all items are subject to availability. Varieties that become unavailable will not be selectable on our website. Should a specific variety not be available at the time of despatch, or if items are of unsuitable quality to send, we undertake to supply a variety of similar colour and habit, and of an equal or greater value or send the item when available. If no suitable substitutes are available, we will send a refund or credit. Should you for any reason (including being unhappy with product substitutions) wish to receive a refund, please contact us immediately to initiate a return.
We are operating a temporary delivery service due to COVID-19. As part of this we will endeavour to make deliveries in a timely manner but to make our deliveries more efficient and more environmentally friendly we will be trying to make deliveries to certain areas on certain days.
Approximate delivery dates are detailed on each product page and we will do our best to make delivery within this timeframe. Weather conditions and natural light levels can affect plant growth rates and government restrictions and staffing levels (in the case of COVID-19) may cause delivery dates to vary. We will contact you if we suspect delivery will be delayed by over 2 weeks but during the Pandemic we will aim to keep you updated to any delays.
Special Conditions for Certain Items
We will ship or deliver your plants to you at the best time for planting. You will have better results if you can plant them as soon as possible after their arrival. It is advisable to prepare your soil, beds or containers ahead of their arrival so you are ready to plant, or pot on your order’s arrival. If you cannot plant immediately, please make sure you open the packing immediately and give them a drink of water.
Some discolouration of the foliage may occur while the plants are contained in the dark during transit, but they will return to their normal colour within a few days. If the plants appear ‘limp’, they will be appreciative of a drink and should perk up. If after a couple of days the plants do not please let us know.
We do our very best to supply you with vigorous, healthy products in prime condition and we ask you to continue their care on arrival.
Our shipping and/or delivery charges (where available) are calculated separately and added automatically to your shopping basket. Special conditions apply to certain postcodes and product types, these will be noted on the product’s page.
The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order at any time up to 14 days after receipt. If you wish to cancel an order please us within 7 working days after receiving your order. You must take reasonable care of the goods whilst in your possession and they must be returned to us, promptly, at your cost. We can arrange collection of larger items, but you will be charged for this service at cost. We reserve the right to cancel any order.
Payment and Vouchers
We accept Visa and MasterCard credit/debit cards and Paypal payments online. You can also pay by card over the phone, by BACS or by cheque. We would recommend placing your order through the webshop and selecting the correct option to to secure your purchase rather than calling the order through or posting the order. We ask that we receive BACS or phone payment within 48 hours of placing your order and cheques within 5 days. Orders will only be dispatched on receipt of full payment. If in the unlikely circumstance we are unable to dispatch your item and cannot make a substitution, we will contact you to issue a refund. Refunds are only payable to the purchaser of the goods.
Online vouchers and order codes are personal to each individual and any inappropriate use is fraud. We reserve the right to cancel any vouchers or order codes at any time. Vouchers cannot be exchanged for cash and have no face value.
Prices listed on our online shop reflect the latest prices for all products. However, we reserve the right to change prices at any time and prices in the nursery may differ due for example to Special Offers or Clearance lines. All prices include VAT, if applicable.
If, in the unlikely event of an error, where a product(s) has been priced inaccurately, either at unit level or through the activation of a promotion, we will not be liable to supply that item(s) to you at the inaccurate price. In such circumstances, we will notify you of the correct price and ask you to confirm or decline your order for the item(s) in question.
Endangered Species / Genetic Modification
We will not knowingly offer for sale endangered species harvested from the wild or any genetically modified products.
Third Party Information
We cannot be held responsible for material displayed on third party websites or any other written material. The only prices that apply for our products are those stated within our catalogues and website. We will not be bound to prices quoted by shopping directories or other media.
